Dear Valued MDHS Supplier:
This book contains McDonnell Douglas Helicopter Company dba McDonnell Douglas Helicopter Systems Purchase Order and Solicitation provisions. These Terms and Conditions of Purchase will be applicable to bid requests or purchase orders issued after April 30, 1994.
For pending requests for proposal, requests for quotation, and open purchase orders, MDHS' Terms and Conditions of Purchase dated February 1993, or prior, will remain in effect.
Upon receipt of a bid request or purchase order from MDHS, the specific provisions incorporated by reference in the solicitation or purchase order and explained in this book should be reviewed thoroughly by the Seller.
PROVISIONS INCORPORATED BY REFERENCE
MDHS provisions offered or incorporated by reference take a number of forms: (1) Solicitation Provisions (SOLPs), (2) General Provisions, and (3) Purchase Order Special Provisions (POSPs).
The SOLPs offered by MDHS are listed in the request for proposal or request for quotation in the narrative section of the form or in select paragraphs of a free text solicitation. Section VIII of this book provides the printed text for MDHS Solicitation Provisions.
- Generally, quality and hazardous material POSPs, when applicable, appear under line items. Other POSPs, including the POSP that incorporates the General Provisions, appear in the initial free text immediately following the last item in the purchase order. General Provisions are incorporated by reference, utilizing a POSP according to the type of contract, as follows:
- General Provisions and FAR, DFARS and NASA provisions for Government Time and Material contracts and Labor Hour contracts are incorporated by POSP 0291-94.
- Modifications to General Provisions and FAR, DFARS provisions for Foreign Contracts are incorporated by POSP 0293-94.
- General Provisions and FAR, DFARS and NASA provisions for Government Fixed Price Incentive contracts are incorporated by POSP 0294-94.
- General Provisions for Commercial Firm Fixed Price contracts are incorporated by POSP 0295-94.
- General Provisions for Short Form -- Goods Contracts are incorporated by POSP 0296-94.
- General Provisions, plus FAR, DFARS and NASA provisions for Government Firm Fixed Price contracts are incorporated by POSP 0297-94.
- General Provisions and FAR, DFARS and NASA provisions for Government Cost Type Contracts are incorporated by POSP 0299-94.
Section IX of this book provides the printed text for MDHS' Purchase Order Special Provisions.
